The Special Waste Regulations 1996
This M Notice is for all Port and Harbour Authorities, Ships Masters and Officers, Ships Agents, Operators and Owners.
This M Notice supersedes Part 4 and Appendix 3 and 4 of M Notice M.1462

1. The International Convention for the Prevention of Pollution from Ships 1973 as modified by the Protocol of 1978 (MARPOL 73/78) does not cover details for the disposal of residues and effluent to reception facilities, the proper disposal of the contents of such facilities remains of critical importance.
2. The Special Waste Regulations 1996 came into force on 1st September 1996. These Regulations aim to ensure that anyone who may consign, carry or receive special waste should be responsible for the proper handling and disposal of that waste.
3. A form entitled “Special Waste Consignment Note” should be completed as described in the following paragraph, a copy of the form is attached as appendix A. Provision and initial completion of this form is the responsibility of the Port/Harbour or operator of the facilities required for all ships waste covered within these Regulations.
4. The Regulations apply where special waste is removed in a harbour area from a ship, to reception facilities that are provided within the harbour area or by pipeline to any such facilities provided outside the harbour area. Prior to the removal of the waste:-
a) Four copies of the consignment note should be prepared;
b) Part A should be completed on each of the copies;
c) The Master should ensure that part C is completed on each of the copies;
d) The operator of the facilities shall ensure:-
(i) Part B is completed on each of the copies
(ii) They have received three copies of the form completed with parts A, B and C completed.
5. The term “special waste” defined in the Special Waste Regulations 1995, applies to any controlled waste:
a) listed in appendix B to this notice;
b) consisting of or containing substances listed in appendix C of this notice;
c) that satisfies the conditions contained in appendix D of this notice;
d) which is a medical product only available by prescription.
The attached appendices B, C and Dare copied from the SI 1996/972 and are subject to amendment by the Regulations.
6. The term “ship” means a vessel of any type whatsoever operating in the marine environment (this includes fixed or floating platforms). The term “carrier” means the person collecting the waste from the premises that it is held and transporting it to another place. Therefore as an example, an Offshore Supply Vessel removing waste from an oil rig would be classed as the “carrier”.
7. Normal ships domestic waste is not affected by these regulations and can be put to shore reception facilities in the normal manner. Domestic waste includes items which can be considered as “household waste”, such as empty containers from ships stores.
8. The Regulations do not include any explicit exemption for small quantities, but it is not intended that the Regulations should be applied regardless of the quantity or degree of hazard of the waste concerned. DOE Circular 11/94 (Welsh Office 29194, SOED 10194) paragraphs 9 and 11 give a “principle of proportionality” and authorities are urged to apply a common sense approach to consignments of waste whose size and characteristics could pose no risk of harm to human health or the environment.

APPENDIX D
LIST OF CONDITIONS
SATISFACTION OF ANY OF WHICH RESULTS IN CONTROLLED

HAZARDOUS WASTE LIST
1. The controlled waste has a flash point below 21°C.
2. The total concentration of substances classified as very toxic is not less than 0.1 %.
3. The total concentration of substances classified as toxic is not less than 3%.
4. The total concentration of substances classified as corrosive and having assigned to them the risk phrase R35 is not less than 1 %.
5. The total concentration of substances classified as corrosive and having assigned to them the risk phrase R34 is not less than 5%.
6. The total concentration of substances classified as irritant and having assigned to them the risk phrase R41 is not less than 10%.
7. The total concentration of substances classified as irritant and having assigned to them any of the risk phrases R36, R37 or R38 is not less than 20%.
8. The total concentration of substances classified as carcinogenic and placed in category 1 or 2 of that classification is not less than 0.1 %.
